RESOLVING DIVORCE CASES

There are a number of ways that divorce cases are resolved. Divorce issues may be resolved by negotiation involving the exchange of written positions with an eventual agreement. They may also be resolved by mediation using a third-party mediator who will attempt to find common ground and promote compromise resulting in resolution of the issues.

Legal Decision-Making for Children

In Arizona, legal decision-making (custody) is no longer automatically awarded to one parent or the other. Instead, the court must consider what is in the best interest of the child when making a determination on legal decision-making. The court will look at many factors when making this determination, including:

  • The child’s wishes (if the child is age 14 or older)

  • Each parent’s ability to provide for the child’s needs

  • The nature of the relationship between each parent and the child

  • Which parent has been more involved in the child’s life up to this point

  • Any history of abuse or neglect by either parent

  • Any other factors the court deems relevant

Parenting Time

Parenting time (visitation) is the time each parent spends with the child. In Arizona, parenting time is no longer automatically awarded to one parent or the other. Instead, the court must consider what is in the best interest of the child when making a determination on parenting time.

Child Support

In Arizona, child support is calculated using a specific formula. The amount of child support you may be required to pay (or entitled to receive) will depend on many factors, including:

  • Each parent’s income

  • The number of children involved

  • The amount of time each parent spends with the child

  • Any special needs of the child

Spousal Maintenance

Spousal maintenance (alimony) is money one spouse pays to the other to help them maintain their standard of living after a divorce. In Arizona, spousal maintenance is not automatically awarded by the court.

Division of Community Property and Community Debts
