Spousal maintenance, also referred to as alimony, is a form of financial aid provided by one spouse to the other during a divorce and potentially for an extended period of time. In Arizona, Attorney Michael D. Miller, Jr., understands that both wives and husbands may be eligible for spousal maintenance depending on their specific circumstances surrounding their marriage and divorce proceedings.

Effective September 24, 2022, for all new dissolution or legal separation cases or modifications of existing cases pertaining to spousal support, we have Spousal Maintenance Guidelines that are in effect. Before the Court applies the Guidelines, it must determine whether a party is eligible for spousal maintenance. Eligibility is based upon a finding that one of the factors under A.R.S. § 25–319(A) applies. Once the Court determines eligibility, application by the Court of the Guidelines is mandatory in all cases. The formula is based upon the incomes of the parties, the length of the marriage, family size and principal portion of monthly mortgage payment. The consensus among experienced family law attorneys is that the new Guidelines can significantly increase the amount of spousal maintenance to be paid and, in the alternative, received. In the event a modifiable award is in place, the Guidelines are applied in any Petition to Modify the award.
